In these Challenge Rules we use the same definitions as the OpenIDEO Terms of Use (the “Terms of Use”).You have viewed an outline of the Challenge on the Site ( and subject to agreement to these Challenge Rules and registration as a User, you (the “Entrant”) will be able to submit Contributions to the Challenge.

By checking the “I agree” box you as an Entrant acknowledge and confirm that you have read, understand and agree to these Challenge Rules (and any amendments thereto), have no objection to them and agree to be bound by their obligations and conditions as set forth herein. As an Entrant you are entering into an agreement withtheQueensland State Government, c/Arts Queensland, GPO Box 1436 BRISBANE Q 4001 / 111 George Street, BRISBANE Q 4000, as the Challenge Host. In the event of conflict the Challenge Rules shall take precedence over the Terms of Use that you havealready agreed to.

If you do not agree to these conditions you will not be able to submit a posting or Contribution for the Challenge.


A short list of winning Contributions will feature at the Arts Queensland IDEAS Festival 2011 to be held from 19-22 May 2011 in Brisbane, Queensland, Australia with the purpose of interesting participant organisations in their future development of the short listed winning Contributions. IDEO will create derivatives of the short listed winning Contributions for presentation at the festival according to the rights you have granted in the Terms of Use.

The winning Entrants will be recognized (acknowledged) at the Arts Queensland IDEAS Festival 2011 and participants will be informed that the short listed Contributions are owned by the Entrant and that if any further development is envisaged the participant organisation should firstly contact the respective Entrant. Winning Entrants shall have no right to attend the Arts Queensland IDEAS Festival 2011 as a result of their Contribution being short listed unless invited to do so. Attendance will be at the Entrants own cost.

The short list of winning concept(s) will also be featured on this Site, the Arts Queensland IDEAS Festival site ( and other sites of any supporter(s) of the Challenge. This will include, without limitation, the right to reproduce, distribute, publish, perform, display and create derivativeworks of the short list of winning concept(s) as in the Terms of Use.

TheQueensland State Government agrees and acknowledges that it must complete this in connection with this Challenge, and in conformity with the selection process set forth in these Challenge Rules.

Stages and Timescale

Due to the nature of Challenges and that Contributions cannot be predicted or elicited at the outset of a Challenge, the Challenge Host acting fairly reserves the right to amend the description of the stages and timescale on short notice.

Selection Process

A key principle in evaluating the Contributions (concepts) for a Challenge is that these are rated by the community of Entrants in the Evaluation stage.

A judging panel has been appointed by the Queensland State Government comprising personnel from the Queensland State Government, IDEO and Studio Propeller PTY. LTD (an agency working with the creative sector appointed by the Queensland State Government) and their purpose is to assist the Queensland State Government define the challenge themes, select concepts for evaluation and review the final rated Contributions to select the winning short list of Contributions for eventual presentation at the Arts Queensland IDEAS Festival 2011.

The judging panel will give your Contribution such consideration as is warranted by its sole judgment. Its review of your Contribution shall not be construed as any recognition of the novelty or originality of your Contribution. Neither the Queensland State Government nor the judging panel is obligated to give reasons for rejecting your Contribution, or for your Contribution not featuring in the winning short list, or to reveal their activities that are related to the subject matter of your Contribution.

The decision of the judging panel is final andan Entrant has no right of appeal.

Intellectual Property

Due to the provisions of the Terms of Use, IDEO and the Queensland State Government, advise against you posting a Contribution if you have made an application for a patent, or other form of registered or unregistered intellectual property, for your Contribution, or part thereof. IDEO and the Queensland State Government accept no liability if an Entrant breaches this advice.



The Queensland State Government and IDEO, in good faith, shall comply with local and national statutes, laws, ordinances, rules, regulations, court orders, and other governmental requirements governing the Challenge. Notwithstanding the foregoing however, the Queensland State Government and IDEO do not warrant or represent that the Challenge is in compliance with any and all laws applicable to each and every Entrant or location in the world from which this Challenge may be accessed, viewed or entered, whether domestic or international.

In addition to, and in light of the foregoing, any Challenge is VOID WHERE PROHIBITED BY LAW.


The Challenge Rules shall terminate when the Challenge is closed unless stated otherwise here.

Jurisdiction and Compliance with Laws

Access to and use of this Site and the terms of these Challenge Rules are governed by the laws of the State of California, USA. You and the Queensland State Government agree to submit to the jurisdiction of the state and federal courts located in the Northern District of California, USA.

IDEO or the Queensland State Government can revise these Challenge Rules at any time by modifying or updating this posting, except where other notice or consent is required by law. Your use of this Site on or after the effective date of any such modification or update will constitute your acceptance of these Challenge Rules as modified and/or updated.
