The rule of law should be the fundamental of any government. However, this has not been the case. Challenges are in multitude, laws are disregarded regularly, even by law enforcement officers, especially those posted to the road. Every state have established their monitoring and enforcement agencies for their road users, the Federal Road Safety Corps has their own rules and laws and the police continue to be active on the road. This configuration is not only problematic but complex, especially for commercial drivers to keep up with all these agencies rules and regulation will be an herculean task. Furthermore, vulnerable groups such as commercial drivers of vehicles, motorcycles (okada) and tricycles (marwa) are mostly culprits in the application of human right issues on road transport system in Nigeria. Moreover, interventions have mostly focus top-bottom approach and protecting the rights of the rich and the educated, this project is taking a different approach driven by the poor and adopting a bottom-top approach to rule of law. This project will also explore the paucity of knowledge and awareness of good road use practice and the danger that it poses to everyone.
D. APPROACH
The proposed approach for this project will be based on the following:
(a) The pilot scheme of the project will be selection of prominent cities in different geo-political zones of Nigeria. Because of the high occurrences of these cases, the selected states is: Lagos (South-West), for the first phase.
(b) Conduct desk research on traffic laws governing the Nigerian Police Force (NPF), Federal Road Safety Corps (FRSC), States’ traffic law enforcement agencies (e.g LASTMA in case of Lagos State) and the roles of the States’ ministry of transportation;
(c) Engage with the representatives of the identified unions on what they think the laws affecting their jobs are while on the roads;
 (d) Process the data received from (a) and (b) above to make the law easy to understand

How is your idea unique? (1,000 characters)

The project activities will involve working with the relevant government MDAs in order to produce a manual that will enumerate all the transport rules, traffic and criminal laws that affect the operations of the commercial drivers and other commercial road users. This will go a long way in building the capacities of the commercial drivers on how they can make use of these laws while interacting with the various law enforcement agencies. The expected key outcomes of the project include: Increased general understanding of the laws that govern the operations of the commercial drivers and other commercial road users; Increased respect for the rule of law; Decreased in the cases of violation of human right with respect to traffic offences; Reduced cases of conflict with the law enforcement agencies. Reduce accidents as well as increase safety of the roads for the commercial road users. Improved behavioural change on issues such as respect, protection and fulfilment of human rights of all

HURIDAC was established in the recognition that human beings must enjoy freedom from fear and want. This implies that conditions must be created whereby everyone can enjoy his or her human rights. It also implies that the equal effective enjoyment of all human rights, without discrimination, underpin the primacy of law. Any society that is not founded on the rule of law will eventually find itself in a state of anarchy. It is with this is mind that HURIDAC is established.

We watch wit agony how commercial drivers rights were violated with impunity by law enforcement officers posted to the road. The lack of knowledge of commercial road users on what law is applicable is immense and weakened that power of the commercial driver to challenged the law enforcement. In some instance this has led to conflict and at times death. This project will reverse this situation.

This project aims to advance the rule of law through effective para-legal training for members of the informal sector (commercial vehicle drivers). While its target beneficiaries are the members of the road transport unions such as National Union of Road Transport Worker (NURTW), Road Transport Employers’ Association of Nigeria (RTEAN0, Tricycle Owner Association of Nigeria (TOAN) and Almagamated Commercial Motorcycle Riders Assocaition of Nigeria (ACOMORAN), its specific objectives include : Advocate for a society where the supremacy of the rule of law will guarantee the protection of citizen’s rights; Strengthen a behavioural change that will customise the observance of rule of law as a norm imbibed by the whole society and institutions of government; See a practice of rule of law that will adopt a bottom-top approach to ensuring compliance to both international and national laws and treaties; and to Advocate for a cultural narrative that imbibes human rights practice.

The members of this association are not stake illiterate, some of them have common knowledge of the situation surrounding their operation.
We will engage with them by having structured training programme with the members of the associations.
The associations has structured of governance and control over their members. The structure will make the management of the project easy.
